Purpose

To provide guidelines for the issuance of apportioned registrations to commercial motor carriers.

Authority

Administrative Revision, Title 28, Chapter 7, Article 7, and 8, A.R.S. § 49-551, and R17-4-302.

Policy

  1. The Division may provide for an apportioned registration, which is a method of registering commercial vehicles operating on an interstate basis in two or more International Registration Plan (IRP) member jurisdiction(s). Under the IRP agreement the Division is authorized to:
  1. Collect registration fees based on percentage of fleet miles operated in various member jurisdictions requested by the applicant.
  2. Transmit the registration fees remitted by the applicant to the member jurisdictions requested by the applicant.
  3. Issue a license plate and registration card (cab card) per vehicle that provides for payment of vehicle registration fees based on the total mileage operated in all jurisdictions for which the fleet vehicle is granted apportioned registration.
  1. An apportionable vehicle is a vehicle that is used or intended for use in Arizona and at least one other IRP member jurisdiction and that is:
  1. Used for the transportation of persons for hire or
  2. Designed, used or maintained primarily for the transportation of property and is:
  1. A power unit having two axles and a Gross Vehicle Weight Rating (GVWR) or registered GVWR in excess of 26,000 pounds or
  2. A power unit having three or more axles, regardless of weight or
  3. Used in combination when the weight of the combination exceeds 26,000 pounds GVWR.

Note: A Recreational Vehicle, a Vehicle displaying Restricted Plates or a government-owned Vehicle, is not an Apportionable Vehicle; except that a Power Unit, or the Power Unit in a Combination of Vehicles having a declared gross weight of 26,000 pounds or less, nevertheless may be registered under the Plan at the option of the Registrant.

  1. An interstate carrier seeking initial apportioned registration must complete and submit the following items:
  1. Full Reciprocity Plan (FRP) Apportioned Registration Application, form #70-0502.
  2. IFTA/IRP Application, form #70-0508.
  3. Operating Authority issued by the Federal Motor Carrier Safety Administration (FMCSA).
  4. USDOT number
  5. Proof of vehicle ownership
  6. International Fuel Tax Account number (same as the Federal Employer Identification Number or Social Security Number).
  7. Federal Heavy Weight Vehicle Use Tax payment receipt, Form #2290, for vehicles subject to the tax.
  1. Applicants applying for an initial apportioned registration must provide evidence to the satisfaction of the Division that the applicant’s physical business is located in the state of Arizona.  “Established Place of Business” means a physical structure owned, leased or rented by the fleet registrant. The physical structure shall be designated by a street number or road location (a PO Box address is not acceptable), be open during normal business hours and have located within it:
  1. A person or persons conducting the registrant’s business.
  2. The availability and maintenance of the registrant’s operational records.

Note:: An applicant that does not have an Established Place of Business in any jurisdiction may designate an Established Place of Residency (as a Base Jurisdiction) in any Member Jurisdiction where the applicant can demonstrate proof of residence and where the Fleet records are maintained or can be made available.

  1. The Division shall not issue an apportioned registration for the following vehicles:
  1. A vehicle that is operated exclusively in this State or a vehicle if the sole purpose of its operation in this State is for conduct in intrastate business.
  2. A vehicle that has been or will be properly apportionally registered in another jurisdiction for which the apportioned registration is sought in this state.
  3. A vehicle that is based in a jurisdiction that does not grant proportional registration reciprocity privileges to fleet vehicles based in this state.
  4. The Federal Motor Carrier Safety Administration (FMCSA) has prohibited the carrier from operating.
  1. The Division shall issue an annual registration card and a permanent validation sticker for each qualified vehicle. The registration card shall be carried in the vehicle at all times and shall be made available to any law enforcement officer on demand. A facsimile of the Arizona registration card may be carried in lieu of the original registration card.
  1. The Division shall not provide a grace period for late registration or late payment of fees.
  1. Apportioned vehicles are not eligible for a biennial registration, see policy 8.9.2 Registration Cycles.
  1. Apportioned fees are not creditable fees as prescribed in Policy 8.14.5 Plate Credit Transfers and Registration Refunds, but the Division may apply any unused portion of the Arizona fees collected (and any other fees specifically allowed by each member jurisdiction) against a subsequent apportioned registration transaction or request a refund of the unused portion of the Arizona fees.
  1. An IRP carrier is authorized to move plates from one vehicle to another upon proper submission of documents and notification to the Division or an Authorized Third Party Provider, on a completed FRP Apportioned Registration Changes Application, form #70-0502A.
  1. The owner of a diesel-powered motor vehicle with a declared gross weight of more than 8500 pounds that is subject to A.R.S. § 28-2153, or registered pursuant to A.R.S. Title 28, Chapter 7, Articles 7 and 8 shall pay an additional or apportioned air quality diesel fee of $10.
  1. The Division may sell temporary proportional registrations, Temporary Permit Authorization (TPA), to an IRP carrier with an existing apportioned fleet, see Policy 8.10.14 Temporary Permit Authorization (TPA) Issuance.
  2. The Division may suspend or revoke a registration license plate or permit if either of the following applies:

  1. FMCSA prohibits the IRP carrier from operating.

  2. The IRP carrier knowingly allowed or required an employee to operate a commercial motor vehicle in violation of a Federal Out-Of-Service (OOS) order.
  1. The Division shall reinstate or reissue a registration (license plate or permit) if FMCSA has allowed the IRP carrier to resume operating.
